Terms & Conditions



Users of the Direct Marketing Association’s website agree to be bound by these terms and conditions.
1. Definitions

1.1 In these terms and conditions, “we”, “us” and “the DMA” means the Direct Marketing Association (UK) Limited, whose registered office is DMA House, 70 Margaret Street, London W1W 8SS. The DMA is a company limited by guarantee. Registered in England No. 2667995.

1.2 The “DMA Bookshop” is the trading name for the DMA’s online bookshop.

1.3 “User” means a visitor to the DMA website and/or the buyer of an item from the DMA Bookshop.

2. Disclaimer

2.1 The DMA regularly updates the website and often includes statistics and information on the direct marketing industry. The DMA uses all reasonable endeavours to ensure the data on its website is accurate and up to date, and where necessary will correct any errors or omissions as soon as practicable. However, the DMA gives no guarantee of the accuracy and currency of the information provided on the website. Nor does the DMA accept liability for any errors or omissions on the website, or the outcome of the use of such information.

2.2 In no event shall the DMA be liable for any loss of profit, revenue, goodwill, opportunity, business or other indirect or consequential loss of any kind in contract, tort (including negligence) or otherwise arising out of use of the website, save where such liability cannot be excluded by law.

2.3 The DMA does not give any warranty that the website is free from viruses or anything else which may have a harmful affect on any technology.

3. Intellectual Property/Copyright

3.1 The copyright in the material contained in the DMA website, including design, text, graphics, code and software belongs to the DMA. All rights are reserved. None of the material may be reproduced or redistributed without the prior permission of the DMA.

3.2 Users interested in copying any information contained in the website should contact the DMA.

3.3 Provided that users acknowledge the DMA as the source of the information they may download or print a single copy for their own non-commercial off-line viewing but are not entitled to make any further copies of that work.

4. Usernames and Passwords

4.1 On becoming a member of the DMA, organisations are issued with a username and a password to enable access to the membership area of the website. The username and password are personal to each organisation and are not transferable to non-member organisations.

4.2 Members are responsible for another organisation using its username and password, and are liable for any payments due for goods or services accessed through the website by anyone using an organisation’s username and password.

4.3 Any breach of security of a username and password must immediately be notified to the DMA.

5. Access to the DMA Website and Content

5.1 Usernames and passwords enable access to documents and resources available only to members. Usernames and passwords should be kept in a private and secure place, and not disclosed to non-member organisations. Organisations interested in becoming members should contact sean@dma.org.uk or call 020 7291 3300 and ask to speak to the Membership Department.

5.2 The information provided on the DMA website is not in any way an invitation or recommendation to buy any products or services featured and, where necessary, users should seek appropriate independent advice.

5.3 The DMA will use reasonable endeavours to allow uninterrupted access to the website but access may be suspended, restricted or terminated at any time without notice.

5.4 The DMA reserves the right to change, modify, substitute or remove without notice any information on the website or posted by members onto the Notice Board area.

5.5 There are links on the DMA website to other websites that may be of interest. The DMA does not accept responsibility for the content of these websites. Users should check the terms and conditions on each of these websites.

6. Formation of a Contract

6.1 No contract will exist between a user of the DMA website and the DMA and/or the DMA Bookshop for the sale of any item unless and until the DMA accepts an order by confirmation email. Acceptance will be deemed complete and for all purposes to have been effectively communicated at the time the DMA sends a confirmation email, whether or not the user receives the email.

7. Making a Purchase from the DMA Bookshop

7.1 If having visited the DMA Bookshop a user wishes to make a purchase from the website they may either complete the online order form or email their request to the DMA bookshop.

7.2 Email requests should be sent to bookshop@dma.org.uk. Online order forms are available on the DMA website in the DMA Bookshop.

7.3 Payment must be received by the DMA prior to despatch. Payment should be sent by cheque to The Direct Marketing Association (UK) Ltd, DMA House, 70 Margaret Street, London W1W 8SS with a copy of the email request or online order form. Cheques should be made out to The Direct Marketing Association (UK) Ltd.

7.4 Orders are not processed until receipt of either a cheque or other agreed method of payment. For details please contact bookshop@dma.org.uk.

8. Pricing and Availability

8.1 Whilst every effort is made to ensure prices quoted are accurate and complete, price and availability information is subject to change without notice. However, the DMA Bookshop is regularly updated to reflect any such changes. If the DMA Bookshop is unable to supply items at the price shown then a user will be informed of the change in price prior to despatch. The DMA Bookshop will await user confirmation and acceptance of the change in price before proceeding with the order.

8.2 If an item is not in stock the DMA Bookshop may place a back order. However, the DMA Bookshop will always email the user with the option to cancel the order. If, beyond its reasonable control, the DMA Bookshop is unable to supply an item, it will immediately advise the user.

8.3 The DMA Bookshop reserves the right to refuse to supply a user. Where the DMA Bookshop does accept an order the item will normally be sent to the purchaser within 30 working days from the date of email confirmation.

8.4 A delivery charge of £3.50 is made for postage and packing.

8.5 The DMA does its best to secure delivery and sends all deliveries via registered post. However, the DMA shall not be liable for loss occasioned by delay in delivery arising out of any cause beyond its control.

8.6 As throughout the UK, all books are zero rated for VAT purposes. This applies whether the user is based within the UK or the EU.

9. Returns and Cancellations

9.1 If a user is unsatisfied with any purchase from the DMA Bookshop the user is entitled to cancel the order within seven days after the day on which the goods are received. The DMA will give a full refund for the cost of the goods and will also refund delivery charges within a maximum of 30 days from receipt of the cancellation notice.

9.2 To cancel an order a user must send an email to bookshop@dma.org.uk with details of the order or call 020 7291 3300.

9.3 The user must return the cancelled goods via registered post and in such a way as to avoid damage to the goods. The user must pay the return charges.

13.1 These terms and conditions are governed by and construed in accordance with the laws of England and Wales and any disputes are to be decided only by the courts of England and Wales.

14. Privacy Policy

14.1 A third party handles the despatch of orders placed with the DMA Bookshop. To enable delivery of an order, users’ contact details are passed to this third party. A written agreement exists between the DMA and this third party, that personal data must not be shared or processed in any way other than to enable delivery of an order.
